Since 2017, when the PA State Legislature changed the law permitting consumer fireworks in safe settings, the Borough has seen an uptick in fireworks causing noise at inappropriate hours and being set off too close to neighboring houses. To celebrate special occasions with fireworks while keeping the Borough safe and respecting the safety and comfort of fellow residents, it is important to be aware of the standards for the sale and use of consumer-grade fireworks, as most recently set by Act 74 of 2022. As of 2017, PA residents can purchase and use “Class C” or “consumer-grade” fireworks. These include firecrackers, Roman Candles, bottle rockets, etc. containing a maximum of 50 milligrams of explosive material. They do not include “ground and hand-held sparkling devices,” “novelties,” and “toy caps,” which are permitted at all times throughout the Commonwealth.

“Display fireworks,” which include salutes that contain more than two grains of 130 milligrams of explosive materials and professional-grade aerial shells containing more than 60 grams of pyrotechnic compositions, can only be used by professionals and require a permit from the municipality.

Anyone over the age of 18 can buy, possess, and use consumer-grade fireworks.

  • Fireworks cannot be discharged at another person.
  • Fireworks cannot be ignited or discharged on public or private property without express permission of the property owner.
  • Fireworks cannot be discharged from, within, or toward a motor vehicle or building.
  • Fireworks cannot be discharged within 150 feet of an occupied structure, whether or not the occupant(s) are actually present and regardless if the building or vehicle is owned by the user of the consumer fireworks.
  • Fireworks cannot be discharged by anyone under the influence of alcohol, a controlled substance, or another drug.
  • Fireworks can only be discharged between the hours of 10:00 p.m. and 10:00 a.m., except on July 2nd, 3rd, and 4th and December 31st, when they can be used until 1:00 a.m.
    • If July 4th falls on a Tuesday, Wednesday, or Thursday, fireworks may be used until 1:00 a.m. on the Friday and Saturday immediately preceding and following the 4th.

Fireworks can be purchased at stand-alone, permanent structures licensed by the PA Department of Agriculture. Consumer fireworks may also be purchased online, through mail-order, or other transaction, but delivery must take place at a licensed, permanent structure.
